1. About these Terms
These Terms and Conditions apply to:
- your use of appetitefor.nz
- enquiries and bookings made with Appetite for NZ
- tours, itineraries and experiences organised or supplied by Appetite for NZ and
- communications, content and services provided by us.
In these Terms, “Appetite for NZ”, “we”, “us” and “our” refer to TOURISM AND BOUTIQUE HOSPITALITY GROUP NZ LIMITED, 9429045879807, trading as Appetite for NZ.“You” and “your” refer to the person using our website, making an enquiry or booking, and each traveller covered by a booking.By using our website, confirming a booking or paying an invoice or deposit, you agree to these Terms.
2. Consumer rights
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the:
- Consumer Guarantees Act 1993;
- Fair Trading Act 1986;
- Contract and Commercial Law Act 2017; or
- any other applicable law,
where those rights cannot lawfully be excluded, restricted or modified.
Where you acquire services for business purposes, and it is fair and reasonable for us to do so, the parties agree that the Consumer Guarantees Act 1993 will not apply to the extent permitted by law. This exclusion does not apply to ordinary consumer bookings.
3. Website information
We aim to keep information on our website accurate and current. However:
- tour descriptions, images and sample itineraries are indicative;
- destinations, suppliers, inclusions, timing and availability may change;
- photographs may be illustrative;
- travel times are estimates; and
- website content may contain occasional errors or omissions.
A tour is not confirmed solely because it appears on our website or because you submit an enquiry.
The specific itinerary, price, inclusions and booking conditions provided in your written booking confirmation take priority over general website content.
4. Enquiries and booking requests
Submitting an enquiry or booking request does not create a confirmed booking.A booking is confirmed only when:
- we have accepted the booking in writing;
- you have provided all information reasonably requested;
- you have accepted these Terms and any tour-specific conditions; and
- we have received the required deposit or full payment in cleared funds.
We may decline a booking where:
- the tour is unavailable;
- minimum or maximum numbers have been reached;
- a supplier cannot accommodate a material requirement;
- we reasonably believe the experience is unsuitable or unsafe for a traveller;
- payment is not received by the due date; or
- accepting the booking would breach a legal, regulatory or supplier requirement.
5. Group bookings
The person making a booking on behalf of a group is the lead booker. The lead booker confirms that they:
- are at least 18 years old;
- have authority to make the booking for all travellers;
- have provided each traveller with these Terms and our Privacy Policy;
- have obtained authority to provide each traveller’s personal information;
- will ensure all travellers receive booking updates;
- are responsible for the accuracy of information supplied; and
- are responsible for making payments unless otherwise agreed in writing.
Each traveller is individually bound by the sections of these Terms relevant to their participation.
6. Prices
Unless expressly stated otherwise:
- prices are in New Zealand dollars;
- prices include GST where applicable;
- prices are based on the itinerary, group size, supplier rates and exchange rates available when quoted; and
- international flights, travel insurance, personal purchases, minibar charges, optional activities and other items not expressly listed are excluded.
